Employment tribunal - a special sort of court dealing only with employment law.

'On the spot' dismissal can only occur because of:

  • Gross misconduct
  • Gross negligence

Fair dismissal can because of:

  • Repeated poor conduct such as lateness
  • Incapacity
  • Repeated inability to do the work required
  • Redundancy

Before an employee is dismissed for any of these reasons they must have received one verbal warning. Followed by at least one written warning. Finally they get a final written warning of their dismissal which they can contest.

Unfair dismissal - where an employee is dismissed without a valid reason or the employer fails to follow the proper procedures

Wrongful Dismissal - this occurs when there has been a breach of the employment contract

Constructive dismissal - this happens when the behaviour of a manager forces an employee to leave the job.

Redundancy - when an employee has to leave their job because they are no longer needed by the business
